EU 2023/988 (GPSR) Consumer Goods Regulation

On June 12, 2023, the General Product Safety Regulation (EU) 2023/988 (GPSR) came into effect. Before December 13, 2024, this new regulation will exist alongside Directive 2001/95/EC on General Product Safety (GPSD).
This new regulation has revised and updated GPSD based on new technologies and online sales, creating new business models, product safety challenges, and new economic operators in the market. Ensuring better product safety is crucial for protecting consumers and providing safe products.
Economic operators and consumers should be aware of the following changes under GPSR:
The product safety legislation of the European Union (EU) is now classified as a regulation, which means it directly applies to all member states.
Economic operators and online market providers should have an obligation to only place secure products on the market.
A new definition has been established for economic operators and online market providers, as well as their obligations.
Manufacturers should draft technical documents regarding the products they put on the market, which should include necessary information to prove that these products are safe. Technical documents should be based on internal risk analysis conducted by the manufacturer, and this information must be kept for 10 years.
Economic operators can also provide information about products and economic operators, as well as instructions and security information, in digital form through electronic solutions such as QR codes or data matrix codes.
When evaluating the security of a product, all relevant aspects of the product should be considered, including new technologies and issues such as network security and digital connectivity.
To evaluate the safety compliance of a product, it is essential to use European standards related to certain products and risks. In the absence of European standards, the national laws of the member states where the goods are sold on the market shall apply.
Economic operators should have an internal compliance procedure to ensure compliance with their responsibilities and obligations.
The new regulations will apply from December 13, 2024.
